Terms of Service
These terms are an agreement between you and Sergey Karakhanyan ("bytemail", "we"), the developer of the bytemail app for macOS and operator of bytemailapp.com. By downloading or using the app or this website you accept them. If you do not agree, please do not use bytemail.
1. The app
bytemail is a mail client that runs on your Mac and connects directly to mail accounts you add. We do not provide a mail service, mailbox hosting or message relay. Your mail provider remains responsible for your mailbox, and your use of that account remains subject to your provider's terms.
2. Licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use bytemail on Macs that you own or control, for personal or business use. You may not sell, rent, sublicense or redistribute the app, remove its notices, or use our name and marks without permission. Reverse engineering is not permitted except where the law expressly allows it. Open-source components included in the app remain under their own licences.
3. Beta software
While bytemail is labelled beta, features may change or be removed, and defects are more likely. Keep independent backups of anything important; your mail provider's copy of your mailbox is the source of truth.
4. Your responsibilities
- Use bytemail only with accounts you are authorised to access.
- Do not use it to send spam, malware or unlawful content, or to violate anyone's rights or your provider's policies.
- Keep your Mac, macOS user account and Keychain secure; anyone with access to them may be able to read your mail.
- You are responsible for the messages you send and the actions you take in your mailboxes, including deletions.
5. Third-party services
Signing in with Google or Microsoft, and connecting to any mail server, involves services we do not control. Their availability, limits and policies may change and can affect bytemail. We are not responsible for third-party services. Google, Gmail, Microsoft, Outlook, iCloud, Yahoo and other names are trademarks of their owners; bytemail is not affiliated with or endorsed by them.
6. Privacy
How the app and this site handle data is described in the Privacy Policy, which is part of these terms.
7. Updates
The app may check for and offer updates. Some updates may be required to keep working with mail providers or to fix security issues.
8. Fees
bytemail is currently offered free of charge during the beta. If paid licences are introduced, the price and what it covers will be shown before you buy, and these terms will be updated.
9. No warranty
bytemail and this website are provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement, to the fullest extent permitted by law. We do not warrant that the app will be uninterrupted or error-free, or that mail will always be delivered, synchronised or preserved.
10. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or business, arising from your use of bytemail. Our total liability for any claim is limited to the amount you paid us for bytemail in the twelve months before the claim, or EUR 50 if you paid nothing. Nothing in these terms limits liability that cannot be limited by law, or the statutory rights you have as a consumer.
11. Ending the agreement
You can stop at any time by removing your accounts from the app and deleting it. We may end or suspend your licence if you seriously or repeatedly break these terms. Sections that by their nature should survive (licence restrictions, disclaimers, liability limits) continue to apply.
12. Changes to these terms
We may update these terms. The new version will be published here with a new date; continuing to use bytemail after that means you accept it.
13. Governing law
These terms are governed by the laws of the country in which the operator is established, without regard to conflict-of-law rules. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and may bring proceedings there.
